Qualifications

  • This position requires an individual who has extensive experience with pharmaceutical healthcare regulations including the anti-kickback statute and regulations and contract drafting and negotiation
  • Demonstrate strong organizational, interpersonal, and communication skills as well as sound judgment with a high level of professionalism and minimal supervision
  • Must possess leadership skills and be detail-oriented, a quick learner, and able to work effectively in a highly matrixed organization
  • Admission to practice law in United States
  • 10+ years practicing law or experience in risk management / compliance in the pharmaceutical or healthcare industry
  • Significant experience with drafting and negotiating contracts
  • Experience negotiating and / or managing programs related to service agreements under the personal services safe harbor to the anti-kickback statute and regulations and significant experience with US healthcare laws required
  • Understanding of healthcare-related laws and regulations and industry standards required, including the federal false claims act, federal anti-kickback statement, OIG regulations and guidance and pharmacovigilance issues
  • Candidate demonstrates a breadth of diverse leadership experiences and capabilities including : the ability to influence and collaborate with peers, develop and coach others, oversee and guide the work of other colleagues to achieve meaningful outcomes and create business impact
  • Strategic, self-motivated, solution focused individual to identify compliance risk exposures and to develop mitigation strategies to address these risks
  • Strong interpersonal skills to work with others within and outside the Company to identify and manage compliance risks are necessary
  • Work Location Assignment : Must be able to work from assigned Pfizer office 2-3 days per week, or as needed by the business

  • The annual base salary for this position ranges from $205,400.00 to $342,400.00
  • In addition, this position is eligible for participation in Pfizer’s Global Performance Plan with a bonus target of 25

Responsibilities

  • Description : The Senior Corporate Counsel for Pricing and Access will primarily serve as counsel for specialty pharmacy contracting and other healthcare compliance issues related to access and reimbursement
  • In this role, the Pricing and Access counsel will provide legal guidance and counsel to business and cross-functional teams in a matrixed corporate environment that requires an enterprise mindset and effective collaboration with internal legal subject-matter experts and key cross-functional stakeholders
  • The role will also be responsible for assisting with proactive compliance effectiveness reviews, coordinating with outside law firms that are engaged to conduct such reviews, and supporting the ongoing development and enhancement of adherence programs and internal policies and procedures to satisfy evolving industry and regulatory compliance requirements within the specialty pharmacy space in the US
  • The position will report to the Assistant General Counsel, Pricing and Access Legal who supports Global Access and Value
  • The role requires significant coordination with Pfizer Compliance colleagues, senior leaders, Pricing and Access Legal colleagues, and external parties such as outside counsel and third-party vendors to address program requirements and reporting on specialty pharmacy interactions
  • The candidate will be skilled at navigating complex matrix organizations in order to effectively communicate and coordinate with business unit subject matter experts and regional level national account directors
  • Assist in the structuring of Pfizer’s contractual relationships with specialty pharmacy providers in master services agreements (MSAs) and statements of work (SOWs) and trade and distribution service agreements
  • Support review and response in continuing negotiations with specialty pharmacies on all MSAs and on specific account SOWs
  • Reviewing proposed customer engagement programs to support appropriate specialty pharmaceutical therapy adherence with attention to fair market value assessment, anti-kickback statute compliance, and safe harbor exceptions
  • Drafting statements of work to capture specific core and supplemental services in specialty pharmacy arrangements
  • Provide counsel on contracting and engagement with the Drug Safety Unit for Customer Engagement Program implementation to support appropriate reporting of adverse events by specialty pharmacy personnel who are performing services for and on behalf of Pfizer
  • Advise internal teams regarding development of patient support roles, considering fraud and abuse laws and other legal framework impacting pharmaceutical manufacturers
  • Work constructively and collaboratively with other members of Pfizer’s Legal Division, legal staff, business colleagues and compliance professionals
